These Terms of Use (“Terms”) govern your access to and use of the game Dare2Play: Fantasy Island (the “Game”), operated by Dare2Play Studios LLC (“Dare2Play,” “Company,” “we,” “us,” or “our”). By downloading, purchasing, installing, accessing, or using the Game, you agree to be legally bound by these Terms. If you do not agree, you must not access or use the Game.
1. Eligibility & Age Verification
The Game is strictly intended for adults 18 years of age or older. By accessing, purchasing, or using the Game, you represent and warrant that:
- You are at least 18 years old;
- You are legally permitted to access adult-oriented content in your jurisdiction;
- All information you provide during purchase or account creation is accurate and truthful.
- We reserve the right to suspend or permanently revoke access if we reasonably believe this provision has been violated.
2. Nature of the Game

4. Purchases, Payments & Digital Delivery
The Game may offer free and paid content. Paid content provides digital access or entitlements delivered electronically immediately upon successful payment. Payments may be processed through:
- App stores (e.g., Apple App Store, Google Play), or
- Third-party payment processors (e.g., Stripe) for direct web purchases.
- Dare2Play does not store full payment card information.
By completing a purchase, you:
- Confirm that you are the authorized holder of the payment method;
- Authorize immediate digital delivery of the product;
- Acknowledge that access begins immediately upon payment confirmation.
5. Refund Policy & Chargebacks
Due to the nature of digitally delivered content that is accessible immediately after purchase:
- All purchases are final and non-refundable, except where required by applicable consumer protection law.
If a chargeback or payment dispute is initiated:
- Your license may be suspended or permanently revoked;
- Access to purchased content may be terminated;
- The Company reserves the right to dispute fraudulent or abusive claims.
- Fraudulent chargebacks may result in permanent blacklisting from future purchases.
6. Intellectual Property
All Game content, including but not limited to text, artwork, design, animations, software, branding, and trademarks, is the exclusive property of Dare2Play Studios LLC or its licensors. No ownership rights are transferred to you under these Terms.
7. User Conduct & Responsibility
You agree to:
- Use the Game lawfully and responsibly;
- Respect consent, safety, and legal boundaries;

You acknowledge that you are solely responsible for your behavior and interactions.
8. Disclaimer of Warranties
The Game is provided “as is” and “as available”. To the fullest extent permitted by law, Dare2Play disclaims all warranties, express or implied, including:
- Merchantability,
- Fitness for a particular purpose,
- Non-infringement,
- Continuous or error-free operation.
We do not guarantee uninterrupted access or compatibility with all devices.
9. Limitation of Liability
To the maximum extent permitted by law, Dare2Play Studios LLC shall not be liable for any:
- Indirect, incidental, special, consequential, or punitive damages;
- Loss of data, profits, or business opportunities;
- Personal decisions, actions, or outcomes resulting from gameplay.
Your use of the Game is at your own risk.
If at any time the Game causes discomfort, distress, or concern, discontinue use immediately.
10. Termination
We reserve the right to suspend or terminate access at our sole discretion if:
- You violate these Terms;
- Fraudulent payment activity is detected;
- The Game is discontinued.
Termination does not entitle you to a refund except where required by law.
11. Modifications
We may update these Terms at any time. Updated versions will include a revised Effective Date.
Continued use after updates constitutes acceptance of the revised Terms.
12. Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles.
Any disputes shall be resolved exclusively in the state or federal courts located in Delaware.
13. Severability & Waiver
If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect.
Failure to enforce any provision shall not constitute a waiver of rights.
